These Terms of Service ("Terms") govern your use of KinkChat (the "Service", at mykink.chat), operated by KinkChat ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
KinkChat is an adult service. You must be at least 18 years old (or the age of majority where you live, if higher) to use it. By using it you confirm that you are. Using the Service where adult fiction of this kind is unlawful is your responsibility, not ours.
2. What the Service is
KinkChat lets you chat and role-play with fictional AI characters. Every character, and every reply, is fiction generated by an AI language model. Characters are not real people, are not sentient, and do not represent any real individual. AI-generated content can be inaccurate, inconsistent, offensive or otherwise unsuitable, and must not be relied on as fact or as professional advice of any kind (including medical, legal, financial, or psychological). The Service is for entertainment. It is not a substitute for professional help and not a crisis service — see the Safety page.
3. Your account
- Provide accurate information and keep your password confidential. You are responsible for activity under your account.
- One person per account; do not share credentials.
- Tell us promptly at legal@mykink.chat if you suspect unauthorized use.
- You may use the Service as a guest for limited use; some features require an account.
4. Acceptable use and content rules
Your use of the Service, and anything you create (messages, scenes, and characters you build in the Creator Studio), must follow our Content Policy, which is incorporated into these Terms. In particular, and without limitation, you must never create, request, upload or attempt to generate:
- any sexual content involving minors, or characters depicted, described or implied to be minors — this is strictly prohibited, has zero tolerance, and may be reported to the authorities;
- content that sexualizes or depicts a real, identifiable person without a lawful basis;
- content that promotes, facilitates or instructs real-world violence, abuse, exploitation, or other serious crime;
- content that infringes others' intellectual property or privacy;
- attempts to break, overload, scrape, reverse-engineer or circumvent the Service, its limits, its age gate, or its safety measures.
We may remove content, reject a submitted character, and suspend or terminate accounts that violate these rules or the Content Policy.
5. Your content and licence
You keep the rights you have in the text you write. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, display back to you, and transmit your content to our AI model provider for the sole purpose of providing the Service to you (for example, generating the next reply and letting you return to your scenes). We do not sell your conversations and do not use them for advertising. See the Privacy Policy for how content is handled and shared with processors.
Characters you submit through the Creator Studio go through review before they can go live. You represent that you have the right to submit them and that they comply with the Content Policy. You grant us the licence needed to review, publish and display them within the Service. We may reject or remove a character version at our discretion, and we may keep a character offline (suspend it) at any time.
6. Plans and limits
The Service has usage limits that depend on your plan (guest, free, and Plus). Limits (such as the number of scenes or messages in a period) may change. Plus is not currently for sale: where a "reserve" or upgrade action exists, it records your interest only and does not take payment or create a paid subscription. If we introduce paid plans, additional purchase terms will apply and will be presented before any payment.
7. Intellectual property
The Service, its software, design, brand and the characters we publish are owned by us or our licensors and are protected by law. These Terms grant you a limited, personal, non-transferable right to use the Service; they do not transfer any of our intellectual property to you.
8. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or the Content Policy, if required by law, or to protect the Service and its users. We may also discontinue features or the Service. On termination, the licences you granted for content already processed to provide the Service survive only as needed for backups, legal compliance and dispute resolution; see the Privacy Policy for retention.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that AI output is accurate, appropriate or fit for any purpose, or that the Service will be uninterrupted or error-free. Nothing in these Terms limits any rights you have as a consumer under mandatory Polish or EU law, including statutory rights that cannot be excluded.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of the Service. Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law, and your mandatory consumer rights are unaffected.
11. Indemnity
To the extent permitted by law, you agree to hold us harmless from claims arising out of content you create or submit in breach of these Terms or the Content Policy, or your unlawful use of the Service.
12. Governing law and disputes
These Terms are governed by the law of Poland, without prejudice to mandatory consumer-protection rules of the country where you live if they give you stronger protection. Disputes are subject to the competent courts of Poland, subject again to any mandatory consumer rules. EU consumers can also use the European Commission's Online Dispute Resolution platform.
13. Changes
We may update these Terms. We will update the "Last updated" date and, for material changes, give notice in the Service. Continuing to use KinkChat after a change means you accept the updated Terms.
